RETURN, WITHDRAWAL, EXCHANGE AND REFUND POLICY

Atlantix is committed to providing high-quality products and professional customer service.
This Return, Withdrawal, Exchange and Refund Policy applies to purchases made from Atlantix and is subject to the mandatory rights granted to consumers under applicable Portuguese and European legislation.
Nothing in this Policy limits or excludes any mandatory consumer rights.

2. Right of Withdrawal — 14 Days
For distance contracts concluded with consumers, the consumer generally has the right to withdraw from the purchase without providing a reason within 14 calendar days from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
This right is subject to the exceptions established by applicable law.

The customer should clearly state their decision to withdraw from the purchase and provide the order number or other information allowing the order to be identified.
A customer may also use the applicable statutory withdrawal form where appropriate.

3. Returning Products
Following the exercise of the right of withdrawal, the customer must return the products within the period established by applicable law.
Products should be returned in appropriate condition, together with their original packaging, accessories and accompanying materials where applicable.
The consumer may be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, as permitted by law.

4. Products Excluded from the Right of Withdrawal
The statutory right of withdrawal does not apply where a legal exception exists.
Depending on the nature of the product, exceptions may include:
* sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery;
* goods made to the customer’s specifications or clearly personalised;

For hygiene and safety reasons, Atlantix may therefore be unable to accept returns of certain opened or used products where a statutory exception applies.

5. Return Shipping Costs
When a consumer exercises the statutory right of withdrawal, the consumer is generally responsible for the direct cost of returning the goods, unless Atlantix has agreed otherwise or applicable law provides otherwise.
Where a product is defective, damaged or incorrectly supplied, Atlantix will bear the applicable costs in accordance with Portuguese law.

6. Damaged, Defective or Incorrect Products
If a product arrives damaged, defective or does not correspond to the customer’s order, please contact Atlantix as soon as possible.
For faster processing, customers are encouraged to provide:

* description of the issue;
* photographs of the product;
* photographs of the packaging, where relevant.
Atlantix will assess the claim and provide an appropriate remedy in accordance with applicable consumer protection legislation.

7. Legal Guarantee of Conformity
Products purchased from Atlantix by consumers are covered by the applicable legal guarantee of conformity.
Under current Portuguese legislation, movable consumer goods generally have a three-year legal guarantee.
Where a lack of conformity is covered by the legal guarantee, the consumer may have rights including repair or replacement and, where legally applicable, a proportionate reduction of the price or termination of the contract.
During the first two years following delivery of a movable good, Portuguese law generally presumes that a lack of conformity that becomes apparent existed at the time of delivery, unless the contrary is established.

The legal guarantee does not cover situations excluded by applicable law, including defects caused by misuse, accidents or other circumstances attributable to the customer.

8. Exchanges
Where permitted by law and subject to product availability, Atlantix may offer an exchange.
If the requested replacement product is unavailable, Atlantix will provide the remedy required by applicable law.

9. Refunds
Where a refund is legally due, Atlantix will generally use the same payment method used for the original transaction, unless another method has been expressly agreed and the customer does not incur any additional costs as a result.
For statutory withdrawals, refunds will be made within the period required by Portuguese law.
Atlantix may, where legally permitted, withhold reimbursement until the returned goods have been received or the customer has provided evidence that the goods have been returned.
Under Portuguese rules governing distance contracts, reimbursement following a valid withdrawal is generally due within 14 days after the trader has been informed of the consumer’s decision, subject to the statutory rules concerning receipt of the goods or proof of their return.
